Copyright in Photographs

If it is possible, it would be great to get as much information as you can from the owner of the photograph – you can add this to your community group’s register of collections.

The two most critical questions are:

  • When was the photograph taken?
  • Who was the photographer?

Photograph copyright law is very complicated – it is governed by the ‘Copyright, Designs and Patents Act of 1988’, and ownership can differ as photographs are considered ‘artistic works’ which have special conditions surrounding them.
