Hampshire County Council and Hampshire PCT wanted to enter into a section 75 agreement of the NHS Act 2006 in which the PCT would delegate its power to place and manage contracts to the Council. This would enable the Council to undertake the function of commissioning substance misuse services in HMP Winchester (Winchester prison) and in the community on behalf of its partners – the PCT, Winchester Prison and Hampshire Probation.
Hampshire County Council and NHS Hampshire have consulted with prisoners and staff in Winchester prison, people using community substance misuse services, staff involved in delivering services in the prison and community, Hampshire LinK and relevant voluntary organisations.
In March 2011 the Department of Health issued a letter advising that funding for the clinical drug treatment, non-clinical psychosocial interventions and some drug testing would be brought together and that in future there should be a single contract for all these substance misuse services in prisons.
Additionally, it said that this commissioning should be undertaken through the DAAT (Drug and Alcohol Action Team), which in Hampshire sits in the Council. This means that the new contract which has to be in place by 3rd October 2012 needs to be procured using the Council’s processes with the Council entering into the contract with the successful bidder for the contract.
