1.1 Structural maintenance and resurfacing restores the fabric and the structural life of the highway thereby protecting the asset. Increased traffic flows have resulted in greater wear and tear and heightened the need to monitor condition and prioritise treatments at suitable intervention points.
2.1 Section 41 of the Highways Act 1980 imposes a duty on the Highway Authority (Hampshire County Council) to maintain those roads which are maintainable at public expense.
2.2 Section 58 of the Highways Act 1980 states that a statutory defence against claims is provided where the Highway Authority can establish that reasonable care has been taken to ‘secure that the part of the highway to which the action relates’ to a level commensurate with the volume of ordinary traffic such that ‘was not dangerous to traffic’.
3.1 The County Council as the Highway Authority shall identify any part of the highway network requiring structural maintenance treatment or planned surfacing works using a system of regular highway inspections or other methods.
3.2 The County Council shall prioritise any part of the highway network in need of structural and planned surfacing works according to relative need using appropriate visual and mechanical survey techniques.
