Monitoring Fees

New regulations governing fees for the monitoring of mining and landfill sites (the Town & Country Planning (Fees for Applications and deemed applications) (Amendment) (England) Regulations 2006) have been introduced. These Regulations were approved by Parliament on 28 March 2006 and came into force on 6 April 2006.

The Regulations provide for the payment of a fee to Mineral and Waste Planning Authorities in England for monitoring of mining and landfill permissions.

Fees are to be charged for a set number of monitoring visits to all mining and landfill sites. The number of visits will be dependent on the stage of operations at each site; whether operational, in aftercare or inactive. The number of visits is to be agreed with each operator and will be in line with an assessment of each site made by the County Council.

  • Active sites will be charged at £288 per visit for between 4 and 8 visits per year
  • Sites in aftercare will be charged at £288 for 1 visit per year
  • Inactive sites will be charged £96 for 1 annual visit

The County Council is currently at the stage of assessing all sites and the number of chargeable visits to be made to each site. The operators of all mining and landfills in the county have been informed in writing of the new regulations along with a provisional figure for chargeable visits. These figures will be confirmed shortly, following negotiations with the operators and a Local Area Guidance document (detailing how the new fees regime will be implemented in Hampshire) will be sent out to all operators. The Monitoring Fee’s regime will then be rolled out County-wide.
