Decision to be re-determined

The appeal decision (20/9/07) was successfully challenged by New Milton Sand and Ballast and a Consent Order was issued by the High Court on 20 August 2008 quashing the decision by the Secretary of State. The status now is that the case has to be re-determined. The Secretary of State has asked for representations from the parties involved in the original Local Public Inquiry.

On 13 August 2004 New Milton Sand and Ballast submitted a planning application for extraction of sand and gravel at Downton Manor Farm, which was refused by Hampshire County Council's Regulatory Committee on 19 October 2005. New Milton Sand and Ballast have appealed against this refusal to the Secretary of State. A Local Public Inquiry is scheduled to begin on 17 April 2007 (Appeal Reference: APP/Q1770/A/06/2014823).
