Traffic Regulation Order

Highways – Permanent Traffic Order Notices from Gosport Borough Council in Gosport area.

NOTICE is hereby given that THE GOSPORT BOROUGH COUNCIL make the following order under Sections 32 and 35 of the Road Traffic Regulation Act 1984 (hereinafter referred to as "the Act") and as agent for the Hampshire County Council under Sections 45 and 46 of the Act to come into force on 1 January 2013.

THE BOROUGH OF GOSPORT (OFF-STREET PARKING PLACES) (GOSPORT AND LEE-ON-THE-SOLENT) ORDER 2012

The effect of the Order will be to revoke and re-enact with amendments the BOROUGH OF GOSPORT (OFF STREET PARKING PLACES) (GOSPORT AND LEE-ON-THE-SOLENT) ORDER 2010 so as to:-

(a) impose conditions on the use of the off street parking places and designation of parking places on highway within the Borough of Gosport

(b) impose a Standard Charge or Excess Charge where relevant, which will apply when any condition of the Order is breached

(c) impose the parking charges detailed below

No Public Service Vehicle or Goods Vehicle exceeding 2225 kilograms unladen weight shall be brought in to or left in a parking place except for the following:-

Mumby Road Lorry Park – Public Service Vehicles and Goods Vehicles exceeding 2225 kilograms unladen weight accepted.

Fort Road Car Park – Public Service Vehicles accepted.

Beach Road Car Park - Public Service Vehicles accepted.

Watergate Car Park - Goods Vehicles exceeding 2225 kilograms unladen weight accepted.

Additional provisions

Provision to allow the service of notices demanding payment of the Standard or Excess Charge (Parking Charge Notice) by first class post.

Provision to clarify that where the period for payment of the Standard or Excess Charge ends on a non-working day the time period is extended to the next working day.

Provision to close all or part of a car park on 24 hours' notice except in the case of an emergency when no notice will be given.

Provision to allow the Council to issue other parking devices and apparatus.

Documents giving more detailed particulars of the Order are available for inspection and may be inspected at the Town Hall Gosport during the hours of 9.00am to 5.00pm Monday to Friday.

If any person wishes to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Act, or that a requirement of the Act has not been complied with, that person may, within six weeks from the date on which the Order is made, apply for the purpose to the High Court.
