THE HAMPSHIRE (TEST VALLEY BOROUGH NO. 53) (PARISH OF CHILWORTH) DEFINITIVE MAP MODIFICATION ORDER 2013
On the 10 August 2016 the Secretary of State for Environment, Food and Rural Affairs confirmed this Order with modifications. The effect of the Order as confirmed is to modify the definitive map and statement for the area by upgrading that part of Chilworth Bridleway 2 that runs from a point at SU 4073 1828 to a point at SU 4069 1799 to a Restricted Byway, and by upgrading Chilworth Footpath 3 from a point at SU 4070 1785 to a point at SU 4058 1658 to a Restricted Byway, with the width of Restricted Byway 3 being 7 metres at SU 4070 1785 thereafter on a width varying between 4 metres and 4.5 metres (save for a width of 6.5 metres at SU 4076 1767) to SU 4078 1743 which has a width of 4.5 metres. Widths taken by reference to the 1865 – 1867 First Edition Ordnance Survey 25 inch to 1 mile map. Thereafter 3 metres wide to SU 4058 1658. A copy of the Order and the Order map have been placed and may be seen free of charge at the offices of Hampshire County Council, The Castle, Winchester, SO23 8UJ, and at the offices of Test Valley Borough Council at all reasonable hours, or online at http://www.hants.gov.uk/publicnotices. Copies of the Order and the map may be bought from me at a price of £2.00. The Order came into force on 10 August 2016 but if any person aggrieved by the Order wants to question its validity or that of any provision contained in it on the ground that is not within the powers of the Wildlife and Countryside Act 1981, or on the ground that any requirement of the Act, or any regulation made under the Act has not been complied with in relation to the Order, he or she may under paragraph 12 of Schedule 15 to the Act within forty two days from 9 September 2016 make application for the purpose to the High Court.
