The Facts

The law prohibits the supply of aerosol spray paint to persons under 16. Those found guilty by magistrates can be fined up to £2,500 under the Anti Social Behaviour Act 2003. Aerosol spray paint is often used in graffiti vandalism, and this legislation was introduced to reduce the amount of graffiti. Results of test purchases:

2004/2005 23 attempts 12 sales (52%)
2005/2006 10 attempts 4 sales (40%)

The volunteers carrying out the test purchases are never older than 14 and a half years old and can never lie about their age if asked by the retailer.

Previous tests have been disappointing and show that some traders are still not aware of the legislation. A mailshot was sent to those stores we thought likely to stock spray paints, with a letter a factsheet and a deterrent poster to display. Those in any doubt of a person’s age must ask for photographic proof of age and if they are still unsure they should refuse the sale.

What are we doing now:

  • Responding to requests from traders about the legislation.

  • Actively seeking information from parents, schools, police, etc. as to which shops are selling to youngsters:

  • Continuing to carry out routine visits at retail premises to give advice on the sale of aerosol spray paint and to encourage the use of due diligence systems.
